Tenor Giuseppe (Joe) Fallisi will testify at a tribunal in Rome on Thursday, October 27, 2011, assisted by Luke Tadolini, as a result of a complaint issued by him against the State of Italy regarding its war on Libya, which influence has been apparent in our country. Formally, the complaint is against "anonymous people", but it is clear that it includes all politicians involved in this tragic and shameful act (President Giorgio Napolitano, Prime Minister Silvio Berlusconi, the deputies and senators who’s vote lead to the involvement of Italy in the war, and even those who financially contributed to the "mission”). According to the complainant, the war against Libya openly violated Article 11 of the Constitution of our country [Italy], which prohibits involvement in war.
The Article states:
Italy rejects war as an instrument of aggression against the freedom of other people and as a means of settling international disputes, but allows, on an equal footing with other states, the necessary limitations of sovereignty to guarantee peace and justice among the other nations; it promotes and encourages international actions which are taken for that purpose.
According to Joe Fallisi, possible "limitations on sovereignty" mentioned at the end of this Article don't contradict with the first sentence of the Article and therefore are no license for war. So what Italy has done and still does in Libya, is nothing but using "war as an instrument of aggression against the freedom of other people," especially after we decided to contribute with our planes to the bombing of the Libyan soil - a country that we never dreamed of declaring war against. Sadly, in addition to this, Italy has violated the "Treaty of Friendship, Partnership and Cooperation" between the Republic of Italy and the Great Socialist People's Libyan Jamahiriya which has been signed three years ago by Muammar Qaddafi and Premier Berlusconi. Among other things, the Treaty provides:
...respect for the sovereign equality of states, the commitment not to threaten and not to use force against the territorial integrity or political independency of the other party, or taking any measures that are incompatible with the Charter of the United Nations, the commitment of non-interference in internal affairs and the commitment to respect the principles of international law, the commitment not to use and not to allow the use of the party’s territories for any hostile act against each other, and the commitment to find peaceful resolutions of disputes.
Approximately two hundred thousand Libyans [including soldiers] have died so far in the neo-colonial aggression in which Italy unfortunately is involved. A prosperous and peaceful country has been bombed and destroyed forever under the false pretext of "humanitarian intervention." A small minority of fanatics who turned out to be murderers, racists and ethnic cleansers were given "recognition", even though they had no one’s support. We [Italy] have also contributed to the killer campaign against the entire Jamahiriya government [meaning all Libyan people] and recently witnessed the alleged torture and murder of Muammar Qaddafi and his son Mutassim. One should have decided, like Germany, not to participate in these horrors. Who has made the opposite choice now must be held accountable.
